I got green card through marriage. My wife is a US citizen and I came here legally and was in legal status(F-1) before getting married. We got married in August 2005. I applied for green card following year and finally got my card approved March 2008. I got a conditional residence which expires March 2010. I did all paperwork myself. My wife recomend me for an attorney for removal of condition. Attorney tells me that USCIS screwed up and sent me a conditonal residence card as under,"Immigration Marriage Fraud Amendments Act of 1986 (IMFA) on November 6, 1986. INA � 216, 8 USC � 1186a","Under IMFA, an �alien spouse� who obtained the status of an alien lawfully admitted for permanent residence by virtue of a marriage contracted less than 24 months before the date of admission is considered to have obtained such status on a conditional basis."
Now he wants me to send the green card back to USCIS as at the time of approval of my petition my marriage had passed more than two years!
I am confused. I need a second opinion.

Wondering what the impact will be for 140 processing with the revised bulletin. Mine EB-2 has been pending in TSC for the last 5 months. It's my understanding we cannot use the AC-21 provisions like switching jobs without approved 140.
If 140 processing goes up to a year that would be really bad for new applicants. Atleast they should resume Premium processing. Any thoughts?

Employment based I485 is pending and priority date is not current, and wont be current until we have cars that fly. Have valid advance parole from EB I485. Plan to file a family based I485 next month and wait for receipt notice and then travel out of country.
Is it possible to return to US on the advance parole from EB I485 after filing FB I485? (Application for a second advance parole based on for the FB I485 will be pending as it takes ~3 months to process AP).

My visa H1-B nd h4 visa was expired on june 30 2010. I have got an job offer and they filed my H1-B petition after july 20 2010. I have submitted my I140 and mine & my wife I485 applications in EB1 category on Feb 22 2010. The gap between the H1b process is nearly 20 days period. The USCIS has approved my H1 but my wife's H4 was denied.
Here is my question. Whether they would have kept the I-94 for me. How can we proceed with H4 denial situation. Please give me some suggesion

Here is my situation. My wife is a US citizen and we've been married for 2 year and 3 months, and I have the conditional green card for almost 2 years. I can't say this has been the best time of my life. She has kids of her own, and we ran into so much problem. And we both wish get a divorce. My conditional green card is expiring, and I know a divorce would affect my status. But seems like I can't take this anymore. During this time, I've been with another us citizen. She understand my situation, and has always supported me. I do want to marry her after my divorce. So, I'm seeking for some advice from everybody on what I should do in this situation. Thank you

I have already moved to AC21 with one of the big firm and now I am planning to move to Small Company. My job duties will remain same and salary will be greater than my labor filled wages. Questions I have are,
1.Does it matter size of new company in terms of money or number employee for continuing my GC process ?.
2. In case of RFE, Will there be question on Ability to Pay on new small company?

I work full time and will continue to work with same employer in the near future, despite having switched to EAD. However, I will use AC21 if a substantially better opportunity presented itself.:)

No. You can file two I-140 petitions from the same employer and your approved H-1B for three years is not in trouble. I don't blame you for your deepest concern in this issue, as USCIS made each and everyone of us so concerned about our every walk of our life.

just wanted some help on filing for EAD (paper application) (self + spouse)
I will be mailing the docs (UPS) to this address:
USCIS
Nebraska Service Center
850 S. Street
Lincoln, NE 68508-1225
I hope this is the right address, we live in california, 2nd EAD, first EAD filed at Nebraska with the old fee. First time EAD was filed by the attorney, this time he is charging way too much.
Along with the application I am mailing the following docs:
1. check $340
2. passport pages
3. first EAD copy and receipt
4. 485 receipt
5. drivers license
6. I 94
7. copy of birth certificate
8. copy of marriage certificate
Does the check list cover everything or am I missing some thing. Please help gurus.

New numbers are out on H-1B usage and the past week showed last week's substantial pickup was just noise. Only 800 visas were claimed against the 65,000 cap, half of last week's total and somewhat less than the typical weekly usage we've seen over the summer. 37,400 H-1Bs have been counted now. i was in same situation. my wife's AP was approved and mine not, before leaving US, so i went for h1 stamping but, my wife didnt. on return, i entered on H1 and she entered on AP.
SFO port. they asked her to go to secondary inspection room, had to wait for 1/2 hr. they called her name, no questions asked, gave her docs back. we both were in.
this was back in Feb'09. i work directly for F100, popular company.

You can transfer your H1 to another company and you will get extension of same validity period (check your I94 Expriry period).
You can retain the priority date of your labour when you file I-140 in the new company.
By the way, why dont you start your I485 process now in the current company? You have lived with them for so long, 6 more months after applying I485, may not be a matter I think.....

Filed July 1st 2007 and my I-485 was transferred from NSC->CSC->NSC. Have a I-485 receipt # that starts with WAC, but is currently pending at NSC. Any recent WAC# approvals?
Tried opening a SR - the SR# ends with CSC. I don't think it will help as SR was directed to wrong Service Center.
In addition to all USCIS inefficiencies, this transfer between service centers makes my case all the more confusing and even more unlikely to be approved anytime soon. Very frustrating!!

I think MVVM is good for the type of apps people are building right now. The way I see it, patterns usually evolve as the type of applications they help build evolve. Many applications even today do not strictly follow a view/model separation even today :P
