I renewed EAD twice using e-file. So far it was all smooth. Very first time I had paper filed and went for FP-ing. Since then renewed twice for myself and my wife - no FPing...got the card smoothly. Again this is USCIS .. someone might have had completely different experience...

Hi folks,
My company filed for I-485 on July 2nd and I am yet to get a receipt for the same. I understand that usually it takes 1-3 months to get FP request after filing I-485 but in these circumstances, what should be the expectation for receiving FP request?
The reason for asking is because my wife is tired of waiting to do a job and is planning to go to India and work there until she gets EAD. If she leaves now and we get a FP request in her absence, what are my options?
1) Can I delay the FP appointment?
2) Can I go alone and have myself finger-printed (assuming that wife doesn't want to come back to US, that is, not interested in GC anymore)?
3) How does it impact EAD/AP which have not been filed yet but will be filed after getting the I-485 filing receipt.

You should get to talk to USCIS coz this is wrong for sure......USCIS should issue you a new EAD with no additional cost.........Even if you do not plan to use EAD card get the issue fixed.......

Is it from receipt date based on receipt notice OR filing date( actual date when USCIS received your 485 package)?

Hi All,
Please share your experience. This is quite urgent. My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.
Questions
1) Now is it ok to file H1B with new title? What if H1B gets rejected?
2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

your father can apply for visitor visa, but there are no guarnatees she will be approved. Even if he is approved and comes to the USA, applying for adjustment of status would be a mistake (entering as tourist while in fact intending to immigrate) and could lead to permanent bar. If he applys and is approved, she can come to visit and return to home country thats the better option.

I was just checking my H1b extension status and it seems that it got approved (3 weeks time). while looking for my H1b extension status i happen to find the link below,
USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/)
It gives the processing trends by month based on trends or volume of application processed. This dashboard is for all applications forms submitted to USCIS, you can select form type, office and chart type. Data can also be downloaded in CSV raw format for analysis.

Change of Status to H1: 10/2004
Labor Filed Substitution: 07/2007
Appeal: 11/2009 in process
I calculated my time in USA excluding time spent outside the country and my 6 years will end in June 2010. When my employer renewed H1 back in 2008 he simply claimed for 3 years and USCIS approved till 03/2011. But I read somewhere online that we have to calculate our time spent in the country and should not go by the date that is on our H1.
1. Does the change of status from H1 to F1 reset the H1 time period or do we have to consider that time period while calculating the 6 years
2. As my application (AAO) is pending I heard I will get a one year extension. The question I have is can I stay on my current H1 till 03/2011 or do I have to renew my H1?

If there is a anti immigration material in any website, instead of pointing a link to it, it is better to copy paste the content here. This way we can avoid HITs to the website. The reverse could be done for pro-immigrant news/articles etc where the link will help us to post comments on the news website directly.
