USCIS has announced that for the third week in a row, the H-1B count sits at 45,000 out of 65,000 used. I presume this means that just a few hundred cases are being processed per week which is simply remarkable when you consider that there has been a lottery for H-1B numbers for the past two years. Can I apply for AP renewal now even if my current AP expires in mid Oct 2009 or should I wait until the expiration date is 90 or 120 days (like H1 renewal).
My EAD expired last year and I have not renewed it, so I should be good on that (I am working on H1) but had a question on AP.

The New York Times today reports on a surgery that is heroic in scope. I am fron the UK and my PD is July 2007. I140 approved Feb 2009. Does anyone have any Idea of the length of the backlog for E3 visas for the UK.

I am currently studying in the US on an F visa and have managed to loose my passport a couple of months ago. The passport itself is replaced but I hesitated to renew the I-94 since it takes longer time than my duration of status and it is cheaper to just leave the country and send a mail to USCIS later with proof of departure.
To the problem, I am changing status from F to A. Since the interview is not required I was able to obtain the new visa through mail. Now, I am currently in the US with a valid new visa but no I-94 which means I will be out of status two months after my F visa expires. Being close to the Mexican border my plan is to cross it and come back on the same day to officially get the A status and a new I-94. I will of course send photocopies of all the papers and stamps to USCIS to not fall out of status on the previous visa. Are there any legal problems doing this?

I have an Indian passport and currently working in USA on L1B visa. Before leaving India I initiated the process of getting permanent residence visa from Australia and while I was in USA I got the AU Independent (Migrant) Visa (Subclass 175) visa approved and it was stamped on my passport by the AU embassy in Washington DC.
My queries are:
- I am planning to go for a vacation to India very soon. While returning to USA will it be a problem with my Indian passport having both USA L1B visa and AU migrant visa.
- For the initial entry to AU, I want to go there next year only for a week directly from USA. Will it be a issue for me to enter the US in my return trip
Your advice on this will be very helpful.

I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.
There are 100s of bills waiting for Co-sponsors published on this website.
I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.
This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.

You are fine. You can continue to work in US on the approved I-797. In US visa is required only to enter into United States. Once you cross the customs and walk into US that VISA is nothing. There after everything is I-94. with I797 you got new I-94 and that reflects your status.

Do priority dates matter now?
with the deluge of applications that will be filed,will the priority dates matter anymore?
lets say someone with a priority date of Dec 2006 (EB2-ROW) applied for 485 in Feb 2007...will his case be processed before a person with a September 2005 priority date that filed in July 2007 (EB2-India)?
so other than allowing us to file the 485 the priority date has no value?
with the deluge of applications that will be filed,will the priority dates matter anymore?
