Hi All,
I am trying to change my wife from H1B to H4. There is this question in I539 for which I am not sure how to reply,
If you answered "Yes" to Question 3g in Part 4 on Page 3 of this form, fully describe the employment. Include the name of theperson employed, name and address of the employer, weekly income and whether the employment was specifically authorized byUSCIS.
would something of this sort be enough
I, xyz am working as a Systems Analyst with abc Inc. My job responsibilities include blah blah.
abc Inc is located at blah.
I am drawing a monthly salary of $xxx. A weekly income based on monthly salary would be $xxx
The employment was authorized by USCIS, the receipt number is EAC-xxxx

USCIS has announced revised filing instructions for numerous petitions, including its Form I-140 (Immigrant Petition for Alien Worker), Form I-130 (Petition for Alien Relative), and Form I-539 (Application to Extend/Change Non-Immigrant Status). The new forms instruct petitioners to file their applications at USCIS Lockbox facilities rather than at USCIS Service Centers.

I am married to a US Citizen and we filed my I-130 petition, which was approved in April 2007. However, the I-797 also notice said that I was not eligible to adjust status from within the US based on evidence presented in the I-130 and that we should consult a local USCIS office to determine what this evidence was. When we consulted an officer at the local USCIS field office, we were advised to proceed with the filing as the language about ineligibility to adjust status in the US was 'standard'.
We have since filed my I485, application for EAD, and AP. Unfortunately I didn't know about priority dates and their impact on our filing. if my priority is not current does this mean that the 485 will be rejected?

You cannot file for a new EAD more than 120 days before the old one expires. You are within that 120-day period, so I would apply ASAP.

Since you're already using EAD, you are no less safer to take up a new job. The most important thing is to be able to keep renewing your EAD til your GC arrives.

Hello all,
I applied for I485 + I150 in June 2007 under EB3. My I-140 is still pending.
Employer used a preappr labor with PD of May 2005. However, the lawyer gave me only the ETA 750B portion of the labor to fill
Now, from some forum I found out that PERM was started in March 2005 and the form was 9089 to be used for labor after march 2005 filings.
So, how did my employer file my labor using ETA750B part which was applicable for old labors since my PD is May 2005 which is after the PERM?
Lawyer and Employer are not willing to help, hence reaching out.

yes, its normal and ok. Your 485 will be processed independently of your I-140, and your fingerprinting, namecheck etc will all keep happening. You just cant get it approved without getting the I-140 approved first. Everything else goes on in parallel.

On July 20, 2010, the House of Representatives passed, by voice vote, the International Adoption Harmonization Act of 2010, to amend the Immigration and Nationality Act with respect to adopted alien children.
The International Adoption (http://www.h1b.biz/lawyer-attorney-1131866.html) Harmonization Act of 2010, HR 5532, will allow an adopted child to legally immigrate so long as the adoption is completed and the petition is filed before the child turns 18. The current age limit is 16. The bill would also restore an international adoption exemption that was inadvertently eliminated when the U.S. joined the Hague Convention on Intercountry Adoptions.
The bill was sponsored by Immigration Subcommittee Chairwoman, Zoe Lofgren (D-CA).
