USCIS has informally advised AILA that it will prioritize the adjudication of H-1B change of status cases for F-1 cap-gap students who are otherwise prohibited from continuing employment after September 30. AILA Liaison has been coordinating with USCIS to help achieve this outcome. USCIS has the means to independently verify these cases.

Mr. Obama might want to consider transferring the authority of setting quotas from Congress to the Labor Department
May be good or bad, depending on how you look at it....we will then be at the mercy of PERM...
If the Labor Department determines that a foreign worker would not displace Americans, that worker should not be barred from entering the country due to an arbitrary quota
This should definitely be high on the agenda.....although its very doubtful if this can ever be implemented.

Please submit contracts, statements of work, work orders, service agreements or letters from/with end-client firms requiring computer related services of the beneficiary. Evidence from other consultants or employment agencies not acceptable. The requested evidence should show specialty occupation work with the actual end-client company where the work will ultimately performed.
My company is big (250+) so why such?? if somebody had same RFE or any guidance or help regarding such matter is higly appreciated.

Effective July 9, 2010, the Department of State revised its visa reciprocity schedule for China to allow for a 12 month, multiple entry visa for H visa applicants. This will allow H-1B visa holders from China to have multiple entries into the U.S. for a 12 month period. While there are some politicians genuinely concerned about the subject of immigration who are backing anti-immigration laws because they believe in the cause, there are many more who have jumped on the anti-immigration bandwagon to score political points (John McCain - I'm talking to you). I wonder if politicians in small towns that don't have a lot of fat in their budgets are going to re-evaluate the costs and benefits when they have to explain to constituents why they have to pay hefty fees to plaintiffs in lawsuits like this one in a small town in Nebraska. Could someone tell me please.....I'm filling the application for advance parole the first time......what should I write where it is written: " Date of intended departure"...if I dont know exactly when I'm leaving....should I write a date or should I write " I dont know yet?"
And also I read that the documents required are 2 photos, I-485 receipt notice, I-140 approval notice.....is that right? or what other documents do I need?
I would highly appreciate your help!

My local congressman got this reply from USCIS on my AP renewal case. Its been over 90 days and pending? Please help with any advice.

The processing of this case has been delayed. A check of our records establishes that this case is not yet ready for decision, as the required investigation into the applicant background remains open.
Until the background investigation is completed, we cannot move forward on this case. These background checks are required to be completed on all applicants who apply for the immigration benefit they are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete.

Hi,
My PD is 2005 and my I-485 was denied on the ground of my birth certificate and I got more proof from where I was born and submitted to USCIS and it was accepted in August 2009 and since then it has been more than a year and there is no update in the online status update for my I-485 application.
Lot of my friends from Late 2005 and early 2006 got the GC's last couple of months. I have requested my Lawyer to make a AILA inquiry? What else can I do at this point?

I count myself as one of the lucky ones as I already have a GC for the last two years and enjoy working in the US. However, my company has offered me a position in Europe for three years and I was wondering how this would affect my green card status. Can I put it on "hold"? If so, is it easy. Any feedback would be appreciated.

Hi,
I got my labor approved couple of weeks back and now attorney is filing I-140. My situation is
Job 1 : Worked from July 1st 2006 to Oct 2nd 2007 (Laid off on that date and h1b was not cancelled ever after)
so applied for h1 transfer immediately, USCIS received application on Oct 9th 2007 (Regular processing)
While I was waiting on that, I got another fulltime job in Nov, Applied for h1 through this company (Premium processing) and got approval within a week, started working from Nov 15th 2007 to till date..
In Decemeber 2007, I got approval for pending H1b from 2nd compnay too.. but never used as i was already working for Company 3.
So, In my labor requirement it was M.S. and 1 yr relevant experience, Labor approval showing employemnt history as
Job 1 : July 1 2006 to Oct 2 2007
Current Job : Nov 15th 2007 to till date
Is it a problem if it shows 1 month gap between these two jobs?

Guys,
I need some advice and your own experiences.
Right now i am with company A(EB3-I, PD:12/2001) and 485 is in progress.
I have another approved I140 with Company B in EB2 category(PD:05/2006) and i did not try to recapture my PD at that time.
My question is, if i interfile company B 140 with Company A 140 would i be able to recapture the EB3 priority date. I do not want to loose the old priority date.
Any pointers or own experiences would be helpful.

Folks,
I was on L1B and H1B for about 2.5 years around 2000-2003. I am now on TN for past 3-4 years and my current employer is going to chagne it to H1B.
The company HR and I are under the impression that this would require a new H1B application (by April 2nd to qualify for the upcoming year 2008 H1B quota). However, the company attorney told us that since I was on H1B in the past, so we don't need to file for a new H1B petition against the 2008 quota...rather we can activate my old H1-B at any time and use the remaining time from the 6 year period.
Does anyone know if there is any such provision to activate the old visa. I am under the impression that as I changed to TN status and no longer hold H1B, so it would require a new petition.
Your opinion would be appreciated.
