My case is NSC>>CSC>>NSC and the received date is listed incorrectly on transfer notice....
Receipt Notice from CSC has correct received date of July 31st 2007
but
Transfer Notice from NSC has received date of Oct 12th 2007
Oct 12th seems to be the date when my case was tranferred back to NSC.
I have 3 questions for you...
1) Are other folks also observing this in their case?
2) Will NSC process my case based on Received date from (CSC notice) or their own transfer notice?
3) Whats the process to get received date fixed?

Since your child turned 21 even before you submitted your I-140, the answer is NO, you cannot submit I-485 for him as he is not covered by Child Status Protection Act, CSPA.

Well I stand corrected. Last night I reported that Rima Fakih was born in the US to immigrant parents. That's what the one biography I could find that listed her birth place actually said. But a day is a long time in the news cycle and we know a lot more about America's newest sweetheart. She was, in fact, born in Lebanon and immigrated as a child. The charming Rima is a graduate of the University of Michigan-Dearborn and is hoping to attend law school when her reign is over. Perhaps a career as an immigration lawyer?

Hi,
My spouse was on H1, the applied for H4 which was approved but he start date was incorrect, so an I102 was applied to get the I-94 corrected , we got the dates incorrect again so the lawyer applied for correct of dates again (October 2010)
In the mean time, we had a family emergency and my wife had to go to India , She went on a valid AdvanceParole. ( We have a pending 485 , so got an AP also)
Today we received a mail from USCIS, asking her to attend an interview regarding this I-94 replacement.
. She is not in US
. She submitted all the I94 cards she had at the Aiport
1. Will she have any problem coming back. She was always on Status. NO issues there
2. Is there any way to postpone the interview ?
3. Does it affect my I-485
4. What is the best course of action

This year, seven months after the opening of the filing season that started on April 1st, the H-1B cap has yet to be reached. However, the numbers may not last long. I did send my wife's and my daughter's RFE in one package. But have separate cover lettter and folder. One packet is enough, clearly distiguish between two set of papers.
My wife and I got RFE on medical. Now I am sending response to RFE. Do I need to send the RFE response individually by FEDEX or Can I send both of us responses in one FEDEX package? Please advise. Thanks.

Hey all,
I am thinking of starting a company in partnership with an American Citizen. I currently hold H1B visa sponsored by my employer. If i start the company in partnership, can my partner/ my firm sponsor my concurrent H1B once the company is setup? My job will be quite similar to the job profile on my primary H1B.
I know the easiest is to be a silent partner, but in my case i might have to be involved 5-10 hours a week. So i understand concurrent H1B in my case would be the best. Any advise or feedback is greatly apprecaited.

I am end of my 6th year of H1B and my current employer filed H1B extension using my approved I-140 (and I don't have EAD). However my employer took the advantage of my immigration status and reduced my salary drastically . I am planning to change my employer after I receive my H1B extension. Now I have following questions
1. If I accept new job with other employer and transfer my H1B to new employer, by what time (months, years..) my new employer has to file PERM to continue my GC process?
2. What if my current employer cancels my I-140 when I moved to new employer? Still can I use that I-140 to port my priority date to new employer?
I can plan my future employment based on your response. Thanks for your time.

Hi,
My H1B Visa expires in Aug 2009 (it was after first extension, till date i have already consumed 3 years 6 months in US). I have following questions,
1. After filing the extension next month, Can I leave to India immediately after getting the receiept (before approval). I might plan to come back to US after a year or so! I will be working at offshore for the same company.
2. If i leave a gap of 365 days, would i regain full 6 years after my re-entry in USA with the existing Visa itself?
I am very sorry if this is a repeated question, i did spend ample time investigating this query and then decided to post this in a thread.

I have to file a loan application which requires me to state if I am a Lawful Permanent resident alien and I am not sure if I am, can somebody please clarify if I am a Lawful Permanent resident alien or not if I have a pening I-485 application and I am working on EAD?

Is core working to get similar bills for HR.5882 and HR 5921 to get introduced in Senate?

As expected this happened, but it happened sooner than expected.
This expected sooner because CIR was voted out in Senate and this was not thought about by this goverment.
Basically this was a close door arrangement between govt agencies which temporarily wanted to lower the friction by IV AND SIMILAR GROUPS.
BUT finally I believe this will come to a rest once we have new government next year.
Till that we are a tennis ball which can be tossed to any court.
PS: I dont even have I-140 and not even applied for one.
So best of luck to all and me.

I am a US Citizen and will be filing a petition (i 130) to bring my mother over on a greencard.
Recently on her visit to the US on a visitor visa she was marked as NO AOS/COS/EOS on her I - 94
and she left by the date specified on her i - 94.
My question is will it have any effect on her GC petition and what is the current wait time for consular processing on an i-130 petition
