The US Chamber of Commerce is seeking a review by the nation's highest court of the Arizona law that calls for the revocation of business licenses for employers found to have knowingly hired illegally present immigrants and also mandates all employers in the state use E-Verify. The case could settle the basic question of what authority a state or local government has in regulating immigration.

I got green card through marriage. My wife is a US citizen and I came here legally and was in legal status(F-1) before getting married. We got married in August 2005. I applied for green card following year and finally got my card approved March 2008. I got a conditional residence which expires March 2010. I did all paperwork myself. My wife recomend me for an attorney for removal of condition. Attorney tells me that USCIS screwed up and sent me a conditonal residence card as under,"Immigration Marriage Fraud Amendments Act of 1986 (IMFA) on November 6, 1986. INA � 216, 8 USC � 1186a","Under IMFA, an �alien spouse� who obtained the status of an alien lawfully admitted for permanent residence by virtue of a marriage contracted less than 24 months before the date of admission is considered to have obtained such status on a conditional basis."
Now he wants me to send the green card back to USCIS as at the time of approval of my petition my marriage had passed more than two years!
I am confused. I need a second opinion.

If the new bill gets approved when will it likely take affect? I just had my LC approved today and they are going to file I-140. Before the EB-3 retrogression for all nationalities i was told i-140 an i-485 could be filed at the same time. what impact does the new bill have on my situation?

Is it possible? Pro-active Finger-Printing without appointment letter.

I have done my FP on March 1st 2005, since the validity is now expired, i called the VSC to enquire when and if i will be getting another FP notice soon.She told me that i can contact the local ASC(Application service centre) and go for the Finger-printing without any formal Notice/Appointment Letter.

Has anybody done this? ie has anybody done Pro-active finger-printing without appointment letter? Please reply.

I just received the I-140 Receipt Notice and noticed that the section I am filed is not correct Sec.203(b)(1)(c) i.e multi-national Executive or Manger

where as I should have been filed for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professionsal

I am going through Substitution process and the Previous I-140 was approved for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professional

Now my question is what is the procedure to rectify this ? Also will I hold on to the processing dates {NOT Priority date} (say May 25th) for I-140 or should the lawyer file new appliaction which will push my I-140 petition dates to June?

Hi
I had contributed $1000 towards my FSA dependent care account in 2010.
Now, in order to claim this amount, both husband and wife should be working, this is not the case with me, as my wife was not able to find a job in 2010.

Will this amount be reimbursed to me by the FSA management company ? as my son went to a preschool, and i paid the school fees every month.

I and my wife are on h1. I want to come on her h4. She recently applied for h1 extension as her employer is nonprofit org and has some policies of his own, he files every year. She filled in may�09 and got receipt number, as the case is still pending who we can apply for h4 now. Is there any way around to apply for my h4 while the case is still pending?

You can file your H-4 based on the H-1b receipt of your spouse, this is not a problem. They will approve your H-4 for the same duration as your spouses H-1, you will get an approval of H-4 only after your spouses H-1 is approved.

Hi
This is my current status

I am on H1 B visa and currently working in the US. My visa expires in July, 2011.

I was sent to the US on a long term onsite assignment from the company I was working in bangalore, India. I am asked to come back to India in June 2010.

What are the implications of me quitting thecurrent job once I go back to India? Is my H1 B visa still valid?
In case if I go back to India and move to a different company, do I have to go through everything starting from filing the H1 petition to get the H1 visa?
