If PD means the date you filed your LC then its May 8th, still not over 90 days.

IV is you me and everybody else. We saw since morning how people are trying to scuttle the idea by giving various and weird reasonings. What is important is writing them. And telling them the gravity and urgency of the situations. words like bonded should be bolded as the truth is 'Yes' in this free American Society we have lived a 'bonded' life...
mirage, I am not trying to turn down this effort. In Fact, I have sent at least 50 letters as part of IV campaigns and I have written so many on my own. All I was saying that we need a professional letter that will have better impact. Once we have the letter ready, I will be the first one to send it out.

Nope, still waiting for I-140. Opened a ticket with both local congressman and USCIS.
CM replied saying "file is with manager for review".....whatever that means...

i had run these numbers a while back. for sure EB2 will reach the end of 2005 this year. i just hope its done systematically so that they clear everybody with an EB2 2005 PD this year.

There was LUD update on my i-485 on 02/05/2009 and 02/10/2009 with no change in the content of the message. Not sure what the update is for. Similarly there was LUD update on my wife's I-485 on 02/10/2009 and 02/11/2009 without any change in the content of the message.

my labor was MS + 2 years. Attorney did not file my I140 under EB2 because I have 23 months full time experience and 2 years GA experience.

2) since there were very less cases between 2003-2004 in I-485 (due to slow BEC processing), this particular case was selected based on RD.
3) but with the current openings, there will be a lot of cases between 2003-2004 enough to use up the numbers esp for india until the next several years.
So i dont think we can guess that the I-485 dates will now be at 2005 or later.

I have reiterated this again and again. There is no way USCIS was going to accommodate all of us as per the original VB. We will form the biggest hump on the back of USCIS and it will probably 20 yrs for every one to come out of the system. Remember, how much math we did on how many years EB2 India /Eb3 india/china will take? Thats what they see as well. Why would they want so many applications backlogged. The only way they can disallow filings is by saying that there are no visa numbers available on day one. You have to have a visa number available at the time of 485 filing. They cleared out all the old PD's. Believe me, If the original bulletin was not current, they would have done the same in 90 days with some numbers gone waste. It was a bad situation for both agencies. I am not saying that they have not goofed up. they goofed up big time and I can clearly see the lack of communication on issue like this which effects so many people. We can use this as an opportunity to show case our root cause or we can use this in a detrimental way that will screw our nuts and bolts for 10 more years.

One one hand you have folks who are getting labor approvals from BECs just now and have not filed I-140s.
On other hand you have PERM folks who have Labor, I-140 certified in 2 weeks.
Don't you think this provision is a bit harsh on those who've waited 3+ years for labor in BECs ?

Cornyn said today. �USCIS�s announcement this year that the cap for H-1B workers was met in just one day, coupled with the recent July announcement that employment-based visas were no longer available for those with advanced degrees, makes clear that industry needs interim relief today until we can return to comprehensive immigration reform. This amendment will go a long way to help out businesses that are the life-blood of the U.S. economy and I hope my colleagues will join me in supporting it.�
Specifically, the Cornyn Amendment would allow the Department of State and DHS to �recapture� unused employment-based visas. This is not an increase in employment-based numbers but rather, a direction for the agencies to use all the visa numbers that are available today. In addition, the Cornyn Amendment also includes a one-time H-1B increase of 115,000 (up from the 65,000) for FY 2008 only.
