I was kind of oblivious and busy in my work since I applied labor �and was thinking everything will fall in place gradually..

Many H1s like me have their non-working spouses on H4 visa who are not given SSNs. Do we not pay taxes ? Do we not pay Social security ? We do, and therefore we should also be eligible for the Stimulus package. Indeed my son is autistic and disabled but we are not eligible for any kind of aid but we pay tons of taxes and social security. It is highly non-justified think. I know people will argue a lot if it is compared to slavery. But it is a "modern form of slavery". Yes, we are in this country with our own will but that is what they are making use of.

I'm telling them my condition, and I know there are lot of people in the same boat. Again you need to talk to the lawyer about GC cost. Emplyee can bear all the GC related cost.
EAD/AP 360*2 + 305*3(Spouse + son) is almost 2K.
If your facts are different put that in writing and send it to them. Please stop telling me my facts. Also I have no idea why you are on this thread, please ignore this thread if it doesn't apply to you...

I don't understand why you are picking up on facts and faults on other post.What mirage is saying is true.I know 3 families stuck up in this GC process...all true cases.
There are some lucky people who have bought old labor substiution ;)who came to US in 2004 and got their GC's cleared and are very :D.
Some really who have come here to study...living in US for past 10 years genuine appliers are really stuck in this.They have all applied their labor and got them cleared only dec 2006.
people who are interested can send those letters if not ignore the thread.
If you are EB2 good for you...Its not that easy to change jobs having families..and when you are satisfied with the employer ,why would they change.
Everyone here want GC to stay in this country.And we all are here to find solutions thru IV - active participation is better.

Found some interesting explanation about New interpretations on section 245(k). This has 180 days tolerance even if you continue work without legal status when in confusion, like the one you asked for.

For example, an alien filed Form I-485 while in H-1B status, the H-1B status expired and the H-1B status was not renewed because of the pending I-485 application and the EAD allowed the alien to remain in the US and continue working. Suppose this I-485 application is denied, and the alien finds that he or she is out status.
If the adjustment application was denied within 180 days of the expiration of the underlying H-1B status, it may be possible for this alien to file a new adjustment of status application under Section 245(k) claiming that the violation was for less than 180 days."
I don't know what happens to EAD when 485 is denied (some says it remains valid) but looks like you get 180 days to fight using an MTR.

The new OBAMA government's agenda is to take the immigration reform during his first year tenure in the ffice. Once the immigration reform took place, I am pretty sure there would be significat changes in employment based category, which drastically decrease the backlogs in all EB categories.
In addtion to that "legals are first than illegals"- OBAMA. This itself is enough for clearing off all the backlogs.

It is true that a lot of the members signed up just so that they can follow the happenings, and maybe post an immediate question that they might have. We may have a huge membership base, but without any action from such a base can make any plan from the core a failure. What we need to do is to energize the baselevel members. The senate is comprised of senators from our respective states, and the house has reps from each state. We have individual state chapeters for IV. I think the Core will need to plan out a strategy to help the state chapters approach their senators and house reps, while the core concentrates on contacting the DoJ committees. Meeting a few senators here and there will not help. We need to contact ALL the senators and apprise them of the situations. Rather than have a different message sent to each senator, the core will need to define an agenda, and the communication needed. The state chapters will need to take that and follow up with their respective senators and reps, without diluting any of the messages. Having the core meet all the senators is not proper, we need to pitch in too. Unless we work as a team, nothing that the core has planned will work.
I was/am a member in immigration.com where all the talk of starting this forum happened. I have interacted with the core on many occassions before, and I was also one of the first to join this community. But work and family pressures prompted me to stay away, and in the meantime, my handle and password were forgotten. I had to resign up, and what I find today is that there is no understanding between the members. Be thankful that this forum was set up, and contribute positively in any way you can. Without your support, the core cant do it all. Lets stop worring about donations and membership fees. We are all intelligent, and highly paid. We have the brains to talk to senators and house reps. Lets move forward to get at least piecemeal legislations passed. Lets not wait for CIR. CIR is not going to happen, so dont believe in it.

It was naive for everyone, including those with PDs in 2006/2007 (and - here's the funny part.. even those who recently filed... ) to suddenly expect the tap to be flowing with full force and everyone's AOS being approved magically in the months of August and September 2008.
We have historical data about the USCIS' efficiencies - but for those who believed (and I'm not excluding myself here... ), it was probably a welcome break, full of hope. It was great while it lasted.
In the process, we've lost focus on the bigger goals - HR 5882 being one of them.
When things were "CURRENT", all we could think of was tracking LUDs and claiming superiority based on an earlier PD or a "U.S. Masters... ".
Again, it's time to take a hard look at past successes and failures, question why we're still in this country, and if you have no doubts about that - get back to the business of pushing for legislation, imho.

Help in working towards getting something done with the bills, the window of opportunity is very short.

Guys, please continue to leave voice messages, emailing & faxing those idiots at Atlanta PERM center who moved the staff to do other work like processing h2b cases. We need to be persistent if we need any positive outcome. Would those idiots who reassigned staff to do other work, now turn around and help us be reassigining more staff to clear the backlogs? We need to keep questioning them and bombard them with emails, fax and phone calls. I have filed EB2 & EB3 with the same company (As explained earlier). EB3 as Programmer Analyst and EB2 as Database Adminstrator ( MS + 2 yrs exp.). I think it is better to take some expert attorney advice on your case. It does not hurt if you consult ( or crosscheck ) with some other attorney about your case. Most of the legal experts charge around $250 to evaluate your case and suggest.

With the economy turning out the way it is I wonder when we will get our next opportunity to bring our issues to Lawmakers notice and ask them to work on our issues. We need to speak up now and we need $$ to fund our organization. I was talking to my mentor syesterday and he is on the board of directors of an organization. He was mentioning to me that if people are losing Jobs, not able to pay their mortgages and struggling to pay for gas and food all other issues will be put on the back burner and the focus on immigration related issues might go down. I am still trying to sink that into my head
