Hi,
The I-485 case of mine, my wife and son was approved on Aug 5 2010. My case is EB2 and priority date is Jan 2006. When I enquired USCIS 2 weeks back on not receiving the physical cards for us yet, we got a reply mail for all of us that USCIS is waiting for our biometrics. Why is a biometrics needed after I-485 is approved? Me and my wife gave our biometrics last September only.
We are not sure when we will receive our biometrics notice and how long will it take to get our physical cards after that? Please guide me on this.
Thanks!

Do we need to sign the I-485 docs on behalf of minors? My daughter is 9 years old and she has signed her papers all by herself. When I asked my attorney, one time she said I need to sign and finally she sent the docs with her signature only.

Hi All,
My I-94 expires in Oct, 2010 and my employer hasn't filed my GC. My 6 year stay expires on Feb, 2011 (don't know why I have oct, 2010 on my I-94)
My one extension has been filed. My question is:
Can I file another extension beyond oct, 2010 saying my 6 years on H1-B are not over (NO PERM or GC yet).
Thanks.

You cannot apply for I-485 unless I-140 is approved as EB1 is purely based on I-140 not labor.

I think this rule got changed now. We have to wait for EAD until it is issued. Now we cant go to their office after 90 days for getting EAD

Labor category has little to do with AC21. Your responsibilties should be 'similar', which is kind of a vague term, which means USCIS would generally not mess with anything that has enough of the same words used in description.

I was wondering about DOL letter which my employer received yesterday..for Recruitment process for 30 days..I wanted to know is it because of the conversion we did to RIR process some days back or is it just that they caught up with my TR application after 5 years..TR-Oct 2001

In compliance with the precautionary measures and the travel health warning issued by the Department of State, the U.S. Consulate in Ciudad Juarez is canceling all immigrant visa and waiver appointments from April 30, 2009, through May 8, 2009. Individuals with immigrant visa appointments scheduled during this time will receive a letter with the rescheduled appointment date. Individuals with a scheduled waiver appointment will be contacted via e-mail or phone regarding the rescheduling.
Additionally, appointments for non-immigrant visas that were scheduled between April 29, 2009, through May 5, 2009, will be rescheduled. Applicants will be contacted by the call center via e-mail or phone. Additional information is available at the Ciudad Juarez Web site (http://ciudadjuarez.usconsulate.gov/h1n1.html).

Regular readers of this blog know that I get upset easily when I hear about how anti-immigration policies negatively impact military families. Soldiers who put their lives on the line to preserve the American way of life deserve better. The Los Angeles Times writes about Frances Barrios, the wife of US Army Spc. Jack Barrios, a soldier just back from Iraq. The Guatemalan-born Frances is facing deportation because she entered the US illegally. She came when she was just six years old. Frances and Jack have a one year old daughter and a three year old son. Jack is suffering...

Dear all,
Could you please help with a question? My family has I140 approved and 485 pending. But we are leaving the US. What is the best way to deal with I485?
1. If we withdraw I485, can I apply for B1 visa later to come back for business? Or because we have applied for immigration visa, our B1 application will be denied?
2. If we change I485 to Consular Process, probably we can not apply for B1, right?
Thanks! Need your expert advice on this.

Hi All ,
I remember last time when PD became current USCIS did not follow the correct order /sequence of PD while allocating visa numbers .
Many of the people who had PD of 2006 got Visa number allocation before people who were in queue ahead of them with 2004/2005 PD.
This time we should have some campaign may be by sending the letter or some way to USCIS/DOS and make them aware to allocate visa based on PD in a fair and transparent way.Any suggestions ????
This opportunity has come after many many years for many of us, we should make our best effort that visa number allocation are done in a fair and transparent way for coming month and month's to come.
Best regards,
amsh

Now the Wall Street Journal picks up the theme. Words are nice. But if you can't control the vitriol coming from the Tea Party wing and actually work with Dems on immigration reform, you're not going to reverse the damage. In short, conservative Hispanics still perceive the GOP as anti-them. And PR campaigns aren't going to fix that problem. But promoting pro-immigration candidates, as some groups mentioned in the article are doing, is a hopeful sign.

I applied for I-485, I-140,and EAD almost 2 months ago..The package was received by USCIS but no receipts yet, no checks are cashed yet...We called and they said it may take 3 months to issue receipts...what should I expect?Receipts and approval of EAD in a month given that they usually honor the 3 months period to approve EAD?or nothing is guaranteed!!

Immigration attorneys are all too aware that U.S. immigration laws are so overly strict our last three Presidents would all be ineligible to even visit our country, much less to qualify for green cards. Think I'm exaggerating? Consider that a person who admits to smoking marijuana a few times, even as a teenager many years ago, is forever banned from entering the U.S. If you were born in the Philippines, before you can qualify for a green card, you must undergo a medical examination at St. Luke's Hospital in Manila to make sure that you do not have a dangerous...
