Based on USCIS's last action rule, the status of an applicant depends on whatever petition is approved last. So, if her H4 is approved after her H1 COS, then she will be on H4.
I am assuming you have applied for H1/H4 extension recently in regular processing. So the chances of her H1 COS getting approved first under premium are higher. So once you get her H1 COS approval, just withdraw her H4 petition.

Hello, My Labor got certified with PD Oct 2003 under EB2.
I have to file for I-140. Where can I check the status whether it is current or lagging back ? Also is there a Premium 140 for EB2 started or not yet? Since I cannot file for I-485 till it becomes available and current to my PD, does it make sense to file for Premium 140 or should I file regularly?
What are the steps for I-140 and any urls where I can see the status..?

I have one question: My I-485 applcation (employment based) was rejected due to I-130 attachment in error.
If USCIS reject my entire package of I-485 because I have attached I-130 application. What are my options? Is there any law that USCIS can only reject I-130 and accept I-485 appplications (myself and for my wife)? I have seperate fee checks for all the applications.
Please help me....

Any ideas? BTW, there is no change in the status. Still says: Case received and pending for i-485 and the same old "message was sent..." on other two.

a.) DO you need latest paystubs for filing for 485.
Suppose, i am working for company A and company B has filed for my GC, then how can this be provided.
b.) Even if i am working for company A, do i still need pay stubs or will a letter stating that "this job is available for the immigrant" suffice.

I am sorry for posting this message on the Immigration group because it doesnt really relate to the immigration issues. I have been a part of this group for a long time, and hence I thought of sharing this with you all. Although we all are here in the US, we all have our families and friends back home in India. Yes, even primary applicant can work on EAD & 1099. But in case RFE is issued for EVL the primary applicant should have permanent full time position.

I heard that there was a deadline to send 45 day letter before end of June this year. And I have seen 45 day letters coming to my friends and me.
Question is: Is there any deadline for them to complete processing all cases???
Another concern. When they are done processing all 350K cases, think of retrogression!
DOL claims on their website all shall be done by Sept 2007.

Degrees evaluation says "UNITED STATES DEGREE EQUIVALENT BACHELOR OF SCIENCE DEGREE IN COMPUTER SCIENCE"
6 yrs + experience prior to joining the current recruiter.
Am I eligible for EB2 category, as my employer says, EB2 be most likely would be rejected/denied and its a big risk

Now that the I-485 gates have been opened, I would like to know what will happen to my spouse's H1B application pending before USCIS? Since I am planning on filing for I-485 for my spouse as well, will the H1B process make a difference? Or will the H1B approval cause any issues to the I-485 application?

Your attorney must have the answer. When you file an I-485, you should include a copy of the I-140 approval or receipt, so your better ask your attorney.
